Terms of Service
These Terms are an agreement between you and OwnIt Health LLC, a Delaware limited liability company ("OwnIt Health", "we", "us"), covering ownithealthcare.com and the OwnIt app at app.ownithealthcare.com. By creating an account or booking a visit, you agree to them.
1. What this service is, and is not
OwnIt Health is a direct-pay telehealth practice. A licensed nurse practitioner provides care by video.
This is not an emergency service. If you are having a medical emergency, call 911. If you are thinking about harming yourself, call or text 988. Do not use messages or booking to report an emergency; nobody is monitoring them around the clock.
We are not a replacement for a primary care practice. There are conditions we cannot treat by video, and when that is the case we will tell you and help you find in-person care.
2. Who may use it
- You must be 13 or older. If you are under 18, a parent or guardian must consent where the law requires it.
- You must be physically located in Delaware at the time of your visit. Our clinician is licensed in Delaware, and where you are sitting decides which state's law applies. Telling us you are somewhere you are not can make the visit unlawful.
- You must give accurate identifying information. We verify a government-issued photo ID before your first visit.
3. Your account
Keep your password to yourself and do not let anyone else use your account. Tell us immediately if you think someone else has access. You are responsible for what happens under your account, except where we are at fault.
4. What you pay
- Every visit costs the same flat price, shown to you before anything is charged.
- Payment is taken when you book. If you have insurance we will tell you what your plan says you owe, and you pay that instead.
- If a visit does not happen because we canceled, because it was never confirmed, or because a technical problem prevented it, you are refunded in full. A visit canceled inside 24 hours, or not attended, is not refunded — see section 5.
- We do not sell memberships or subscriptions. There is nothing recurring.
- We do not store your card number. Payments are processed by Stripe under its own terms.
5. Appointments, cancellations, and no-shows
Requests are confirmed by a person; a request is not a booking until we confirm it.
Payment is collected at the time of booking and reserves your appointment time; it is not a deposit. Appointments may be rescheduled or canceled at no cost up to 24 hours before the scheduled visit. Cancellations made within 24 hours of the appointment, and missed appointments, are not eligible for a refund.
You receive a full refund regardless of timing if your appointment was never confirmed, if OwnIt Health cancels or is unable to see you, or if a technical problem prevents the visit from taking place. Our Cancellation and Refund Policy sets this out in full and forms part of these Terms.
6. Prescriptions
Whether to prescribe is a clinical judgment, made each time. Paying for a visit does not buy a prescription, and we will not prescribe when it is not appropriate. We do not prescribe controlled substances for chronic pain.
7. Your health information
How we use and share your health information is set out in our Notice of Privacy Practices, which controls if it ever conflicts with these Terms. Our Privacy Policy covers information that is not health information, and our Consumer Health Data Privacy Policy covers health-related data that falls outside HIPAA.
8. Your record
You can download your record at any time. We are required to retain medical records for a period set by law and cannot delete them on request — see our Account Deletion Policy.
9. Acceptable use
Do not misrepresent who you are, attempt to reach information that is not yours, interfere with the service, or abuse our staff. Our Cancellation & Refunds · Community Guidelines set out what we expect and what happens if it is not met. Security research is welcome within the boundaries on our security page.
10. Availability
We aim to keep the service available, but it depends on the internet, your device, and third parties. We do not guarantee uninterrupted access. If technology prevents a visit from happening, you are not charged for it.
11. Limitation of liability
Nothing in these Terms limits our liability for professional negligence in the care we provide, for death or personal injury caused by our negligence, or for anything else the law does not allow us to limit. Subject to that, our liability for the platform — the website and app — is limited to the amount you paid us for the visit in question.
12. Disputes
These Terms are governed by the laws of the State of Delaware. Please raise a concern with us first at admin@ehr.ownithealthcare.com; most things are resolved that way. This section does not affect your right to complain to a regulator or to the Delaware Board of Nursing.
13. Changes
If we change these Terms in a way that materially affects you, we will tell you in the app or by email before the change takes effect, and show the new effective date here.
